Case Review
In November 2018, when Zhang was riding a battery car on the road near Chen's house, he was bitten by Chen's dog. Hearing the dog's barking, Chen's dog also came after him. The bite caused Zhang to fall and was injured and was hospitalized. In 2019, Zhang's second surgical treatment was completed. It was identified that Zhang suffered a right knee injury due to a traffic accident, constituting a grade 10 disability. Several parties failed to reach an agreement on compensation, and Zhang sued to Fengyang Court.
The court held that if raising animals causes damage to others, the animal breeder or manager should bear the tort liability, but it can be proved that the damage was caused by the infringed person's intentional or gross negligence, and may not assume or mitigate responsibility. In this case, if Chen and Chen, as animal breeders, the dog they raised chased and bit Zhang, causing him to fall and be injured, and the two had no evidence to prove that Zhang was intentional or grossly negligent, they should be fully liable for compensation to Zhang.

The judge said
Because the animals themselves have certain dangers, they may cause others to be frightened and cause psychological fear and thus induce damage. Therefore, as long as the domesticated animals cause damage to others, they can constitute the responsibility of the domesticated animals for damage. , but not necessarily the premise of taking responsibility for the bite or scratching of other people by the feeding animal. The Civil Code highlights the responsibility orientation in raising animals, plays a normative role in civilized breeding, and urges breeders and managers to pay attention to their own responsibilities. Please consciously abide by the laws and regulations, and keep animals in a standardized and civilized manner.
