Administrative Measures for Animal Quarantine(Revised Draft for Comment)
Chapter 1 General Provisions
First Article In order to strengthen the management of animal quarantine activities, prevent, control, purify and eliminate animal diseases, prevent and control zoonotic infectious diseases, and ensure public health safety and human health, in accordance with the Animal Epidemic Prevention Law of the People's Republic of China (hereinafter referred to as the Animal Epidemic Prevention Law) ), to formulate this method.
Article 2 These measures are applicable to the quarantine of animals and animal products and their supervision and management activities within the territory of the People's Republic of China.
The quarantine of terrestrial wild animals shall be stipulated separately by the Ministry of Agriculture and Rural Affairs in conjunction with the State Forestry and Grassland Administration.
The quarantine of entry and exit animals and animal products shall be governed by the Law of the People's Republic of China on Entry and Exit Animal and Plant Quarantine.
Article 3 Animal quarantine shall follow the principles of process supervision, risk control, regionalization and traceability management.
Article 4 The Ministry of Agriculture and Rural Affairs is in charge of the national animal quarantine work.
The competent agricultural and rural departments of the local people's governments at or above the county level are in charge of the animal quarantine work within their respective administrative areas, and are responsible for the supervision and management of animal quarantine.
The competent agricultural and rural department of the people's government at the county level may dispatch animal health supervision agencies or official veterinarians to townships, towns or specific areas according to the needs of animal quarantine work.
The animal disease prevention and control institution established by the people's government at or above the county level shall provide technical support for animal quarantine and its supervision and management.
Article 5 The animal health supervision agency of the local people's government at or above the county level is responsible for the animal quarantine work within its administrative area, and implements quarantine in accordance with the Animal Epidemic Prevention Law, these measures and animal quarantine regulations.
The official veterinarian of the animal health supervision agency implements the quarantine, issues the animal quarantine certificate, affixes the quarantine mark, and is responsible for the quarantine conclusion.
Article 6 The Ministry of Agriculture and Rural Affairs formulates, adjusts and publishes quarantine regulations to clarify the scope, objects and procedures of animal quarantine.
Article 7 The Ministry of Agriculture and Rural Affairs strengthens the construction of informatization, establishes an informatization system for animal quarantine management, and realizes the traceability of animal quarantine information.
The animal health supervision agency at or above the county level shall do a good job in the management of animal quarantine information and data within its administrative area.
Units and individuals engaged in animal breeding, slaughtering, operation, transportation, isolation and other activities shall fill in the relevant information on animal quarantine in the animal quarantine management information system designated by the Ministry of Agriculture and Rural Affairs in a timely manner as required.
Chapter II Quarantine Declaration
Article 8 The state implements an animal quarantine declaration system.
If animals and animal products are sold or transported, the owner shall declare to the local animal health supervision agency for quarantine three days in advance.
If an animal is slaughtered, it shall report to the local animal health supervision agency for quarantine six hours in advance; if an animal is slaughtered urgently, it can be reported at any time.
If relevant susceptible animals and susceptible animal products are imported into areas without animal diseases, in addition to reporting quarantine to the animal health supervision agency of the exporting place as required, the consignor should also report to the animal where the quarantine site is located at the importing place three days before departure. The health supervision agency declares quarantine.
Article 9 The animal health supervision agency shall, according to the needs of animal quarantine work, reasonably set up animal quarantine declaration points and announce to the public.
The competent agricultural and rural departments of the local people's governments at or above the county level shall establish animal quarantine declaration points in accordance with regulations.
Article 10 Those who apply for quarantine shall submit a quarantine declaration form and other materials prescribed by the Ministry of Agriculture and Rural Affairs, and shall be responsible for the authenticity of the declaration materials.
The declaration of quarantine shall be filled in at the declaration point or declared by fax, electronic data exchange, etc.
Article 11 After receiving the application, the animal health supervision agency shall review the application materials in a timely manner. If the application materials are complete, it shall be accepted; if it is not accepted, the reasons shall be explained.
Any of the following circumstances will not be accepted:
(1) The application materials are incomplete, and the animal health supervision agency has informed the applicant once on the spot or within five days of the content that needs to be supplemented, but the applicant refuses to make corrections
(2) The declared animals and animal products do not belong to the jurisdiction;
(3) The declared animals and animal products do not belong to the scope of animal quarantine;
(4) Other animals and animal products that should not be quarantined as stipulated by the Ministry of Agriculture and Rural Affairs.
Article 12 After accepting the declaration, the animal health supervision agency shall assign official veterinarians to carry out quarantine, and the co-inspectors can assist the official veterinarians to verify relevant information on-site or at designated locations, and conduct clinical health inspections.
Chapter 3 Quarantine at the Place of Origin
Article 13 Animals sold or transported shall be quarantined and meet the following conditions, and an animal quarantine certificate shall be issued:
(1) From non-blocked areas and no relevant animal epidemics have occurred
(2) Animal breeding farms (households) comply with the relevant regulations on risk classification management;
(3) The application materials comply with the regulations on animal quarantine;
(4) The livestock and poultry labels are in compliance with the regulations;
(5) The compulsory immunization has been carried out in accordance with the regulations, and is within the effective protection period;
(6) The clinical examination of health;
(7) Where laboratory disease testing is required, the test results are qualified.
Semen, eggs, embryos, and breeding eggs of breeding animals sold and transported shall meet the requirements of the first paragraph of the preceding paragraph, the application materials shall meet the requirements of the third paragraph of the preceding paragraph, and the donor animals shall meet the requirements of the preceding paragraph after quarantine inspection. Item 4, Item 5, Item 6, Item 7 shall issue an animal quarantine certificate.
For sale and transportation of raw hides, raw wool, cashmere, blood, horns and other products, after quarantine, the breeding farm (household) conforms to the first paragraph of the first paragraph, the declaration materials meet the first paragraph of the third paragraph, and the donor animals meet the requirements of the first paragraph. If the items specified in Item 4, Item 5, Item 6 and Item 7 of the first paragraph, and the disinfection is qualified according to the regulations, an animal quarantine certificate shall be issued.
Article 14 If an animal that has obtained a quarantine certificate at the place of origin continues to be sold or transported from a bazaar specializing in animal management, or if it needs to be transported after an animal exhibition, performance or competition, the animal shall be quarantined and meet the following conditions, and an animal shall be issued Quarantine certificate:
(1) Original animal quarantine certificate and complete entry and exit records;
(2) The livestock and poultry labels meet the regulations;
(3) Clinical examination for health;
(4) If the original animal quarantine certificate exceeds the validity period of transportation, and laboratory disease testing is required as required, the test results are qualified.
Article 15 After the imported dairy and breeding animals arrive at the import site, they shall be under the supervision of the local agricultural and rural authorities for quarantine observation in the isolation field or the isolation house in the breeding field. for thirty days. Those who pass the quarantine observation can be reared in mixed groups; those who are unqualified shall be dealt with in accordance with relevant regulations. If it is necessary to continue transportation after passing the quarantine observation, the owner shall declare for quarantine and obtain an animal quarantine certificate.
Isolation of dairy and breeding animals imported across provinces into areas without animal epidemics shall be implemented in accordance with the provisions of Article 25 of these Measures.
Article 16 If the parents, juveniles, larvae, fertilized eggs, eyed eggs and other genetic breeding materials of aquatic animals are sold or transported, they shall be quarantined and meet the following conditions, and an animal quarantine certificate shall be issued:
(1) No related aquatic animal epidemics have occurred in the seedling production site recently; ) needs to be tested for laboratory diseases, and the test results are qualified.
Aquaculture animals other than aquatic fry and their products are not subject to quarantine.
Article 17 The animals and animal products sold or transported can only leave the place of origin after obtaining the animal quarantine certificate.
Chapter 4 Slaughtering and Quarantine
Article 18 Animal health supervision agencies send official veterinarians to slaughterhouses (fields) to conduct quarantine. The slaughtering plant (farm) shall provide facilities such as the official veterinary on-site quarantine room, studio and quarantine operation table that are suitable for the quarantine work.
Article 19 Animals to be slaughtered entering a slaughtering plant (field) shall be accompanied by an animal quarantine certificate and affixed with livestock and poultry labels that meet the regulations.
Article 20 The slaughtering plant (field) shall strictly implement the system of animal entry inspection and registration, inspection to be slaughtered, etc., check the animal quarantine certificate and livestock and poultry identification of the animals to be slaughtered, and find that the animals are infected or suspected of being infected. If it is found, it shall immediately report to the local competent agricultural and rural department or animal disease prevention and control institution.
Article 21 The official veterinarian shall check the health status of the animals to be slaughtered, carry out simultaneous quarantine and necessary laboratory disease testing during the slaughtering process, and fill in the slaughtering quarantine records.
Article 22 If the following conditions are met after quarantine inspection, an animal quarantine certificate shall be issued on the carcass, raw hide, raw hair, down, viscera, blood, hoof, head and horn of the animal, stamped with a quarantine inspection seal or affixed Other quarantine signs:
(1) The application materials comply with the regulations of animal quarantine;
(2) The health of clinical examination;
(3) The simultaneous quarantine is qualified;
(4) Laboratory disease testing is required Yes, the test result is qualified.
Article 23 The official veterinarian shall recover the animal quarantine certificate attached to the animals to be slaughtered in the slaughterhouse (field), and upload the relevant information to the animal quarantine management information system. The storage period of the recovered animal quarantine certificate shall not be less than twelve months.
Chapter 5 Animal Quarantine for Entry into Areas Without Regulations for Animal Diseases
Article 24 If the relevant susceptible animals and animal products are transported to areas without regulations for animal diseases, unless the animal health supervision agency of the exporting place is attached In addition to the animal quarantine certificate issued, it shall also apply for quarantine to the animal health supervision agency at the county level where the isolation site of the importing place is located, and obtain the animal quarantine certificate in accordance with the provisions of Articles 25 and 26 of these Measures.
Article 25 Relevant susceptible animals imported into non-specified animal disease areas shall be quarantined in the isolation place designated by the provincial animal health supervision agency in the importing area. The isolation and quarantine period is 30 days. The cost of the quarantine period shall be borne by the shipper. Those who pass the isolation and quarantine shall be issued an animal quarantine certificate by the official veterinarian of the county-level animal health supervision agency where the isolation site is located.
Article 26 Relevant susceptible animal products imported into non-regulated animal disease areas shall be subject to quarantine at the location designated by the provincial animal health supervision agency in the importing area in accordance with the relevant quarantine requirements of non-regulated animal disease areas. Those who pass the quarantine shall be issued an animal quarantine certificate by the official veterinarian of the local county-level animal health supervision agency.
Chapter VI Official Veterinarians
Article 27 The state implements a system of appointment of official veterinarians. Official veterinarians should meet the following conditions:
(1) Staff members of animal health supervision institutions, or staff members of other institutions receiving professional guidance from animal health supervision institutions;
(2) Engaged in animal quarantine work;
(3) Have a junior title or above in animal husbandry, veterinary and aquatic products, or a college degree or above in related majors, or have been engaged in animal epidemic prevention and other related work for more than three years;
(4) Receive pre-job training and undergo Qualified in the assessment;
(5) Comply with other conditions stipulated by the Ministry of Agriculture and Rural Affairs.
Article 28 The animal health supervision agencies at or above the county level shall propose the appointment of official veterinarians to the competent agricultural and rural departments at the same level, and report to the competent agricultural and rural departments for review. Those that pass the examination shall be confirmed by the provincial competent agricultural and rural departments according to the procedures, uniformly numbered, and reported to the Ministry of Agriculture and Rural Affairs for the record.
Official veterinarians confirmed by provincial agricultural and rural authorities are appointed by the agricultural and rural authorities where they belong, issue official veterinary certificates, and publish the list of personnel.
Article 29 An official veterinarian shall hold an official veterinary certificate when carrying out animal quarantine work. It is prohibited to forge, alter, lend or otherwise illegally use official veterinary certificates.
Article 30 The Ministry of Agriculture and Rural Affairs shall formulate a national official veterinary training program.
The competent agricultural and rural departments of the local people's governments at or above the county level formulate training plans for official veterinarians in their respective administrative regions, provide necessary training conditions, set up assessment indicators, and regularly conduct training and assessments for official veterinarians.
Article 31 The animal health supervision agency may, according to the needs of animal quarantine work, designate qualified inspection assistants to assist official veterinarians in implementing animal quarantine. Co-inspectors are not allowed to issue animal quarantine certificates.
The conditions and management requirements of the co-inspectors shall be formulated by the provincial agricultural and rural authorities.
Article 32 The licensed veterinarians or animal epidemic prevention technicians in animal farms and slaughterhouses (fields) shall assist official veterinarians in implementing animal quarantine.
Article 33 For personnel engaged in animal quarantine work, relevant units shall, in accordance with state regulations, take effective health protection and medical care measures, and fully implement relevant treatment such as animal husbandry and veterinary medical and health allowances.
The animal health supervision agencies and official veterinarians who have contributed to the animal quarantine work shall be commended and rewarded in accordance with the relevant state regulations.
Chapter VII Quarantine Badges and Marks
Article 34 Animal Quarantine Badges and Marks include:
(1) Animal Quarantine Certificate;
(2) Animal Quarantine Seals and Quarantine Marks;
(3) Other animal quarantine badges and marks prescribed by the Ministry of Agriculture and Rural Affairs.
Article 35 The content, format, specification, coding and production requirements of animal quarantine badges shall be uniformly prescribed by the Ministry of Agriculture and Rural Affairs.
Article 36 Animal health supervision agencies at or above the county level are responsible for the management of animal quarantine badges and signs within their administrative areas, establish an animal quarantine badges and signs management system, and strictly follow procedures to order, store and issue.
Article 37 No unit or individual may forge, alter, transfer or lend animal quarantine badges, and may not possess or use forged, altered, transferred or loaned animal quarantine badges.
Chapter VIII Supervision and Management
Article 38 It is prohibited to slaughter, operate, and transport animals that are subject to quarantine according to law but have not been quarantined or have failed quarantine.
Prohibit the production, operation, processing, storage and transportation of animal products that should be quarantined according to law but have not been quarantined or have failed quarantine.
Article 39 For animals and animal products that fail to pass the quarantine inspection, the official veterinarian shall issue a quarantine treatment notice, and the owner or slaughterhouse (farm) shall handle them in accordance with the relevant state regulations under the supervision of the competent agricultural and rural departments.
The animal health supervision agency shall report to the competent agricultural and rural authorities at the same level in a timely manner the situation of unqualified quarantine.
Article 40 Under any of the following circumstances, the animal health supervision agency that issued the animal quarantine certificate or its superior animal health supervision agency shall revoke the animal quarantine certificate at the request of the interested party or in accordance with its authority, and notify the relevant authorities in a timely manner Units and individuals:
(1) Official veterinarians abuse their powers or neglect their duties to issue animal quarantine certificates;
(2) Official veterinarians conduct quarantine beyond the scope of animal quarantine and issue animal quarantine certificates;
(3) Official veterinarians fail to implement quarantine in accordance with the provisions of these Measures and quarantine regulations, and issue animal quarantine certificates; Animals and animal products that meet the qualified standards are issued an animal quarantine certificate;
Article 41 Under any of the following circumstances, it shall be subject to quarantine in accordance with the law and shall be punished without quarantine:
(1) The animal species and the name of the animal product are inconsistent with the animal quarantine certificate;
(2) The quantity of animals and animal products exceeds the quantity stated in the animal quarantine certificate;
(3) The transferred animal quarantine certificate is used.
Article 42 The animals and animal products that should be quarantined in accordance with the law but have not been quarantined shall be handled and punished by the competent agricultural and rural departments of the local people's governments at or above the county level in accordance with the Animal Epidemic Prevention Law. Carcass, meat, organs, fat, blood, semen, eggs, embryos, bones, hooves, heads, tendons, eggs and other animal products that should be quarantined according to law but have not been quarantined shall not be subject to supplementary inspection.
Article 43 If the animals subject to supplementary inspection meet the following conditions, they shall pass the supplementary inspection and issue an animal quarantine certificate; if they do not meet the conditions for supplementary inspection or fail to pass the supplementary inspection, they shall be confiscated and destroyed:
(1) Livestock and poultry The label meets the requirements;
(2) The quarantine declaration materials are complete and meet the requirements;
(3) The clinical examination is healthy;
(4) The conditions specified in the first or second items are not met, and the owner shall provide the quarantine regulations The laboratory test report of the specified quarantine object, and the test result is qualified.
Article 44 If the animal products such as hides, raw wool, down, horns and other animal products for supplementary inspection meet the following conditions, they shall pass the supplementary inspection and issue an animal quarantine certificate; if they do not meet the conditions for supplementary inspection or fail to pass the supplementary inspection, they shall be confiscated and destroyed :
(1) There is no decay and deterioration after visual inspection;
(2) Disinfection according to regulations;
(3) The owner provides the laboratory test report of the quarantine object stipulated in the quarantine regulations, and the test result is qualified.
Article 45 For animals and animal products that have passed the quarantine inspection, the carrier shall transport them according to the destination stated in the animal quarantine certificate and arrive within the specified time; if animals are transported across the provincial level, they shall be approved by the people at the provincial level. Designated channels established by the government to enter or pass through the province.
Feeding farms (households) or slaughtering plants (farms) shall not accept animals that do not have valid animal quarantine certificates and enter the province without designated passages.
An outbreak of an epidemic in an animal that has passed the quarantine shall be reported and disposed of in accordance with relevant regulations.
Article 46 After the transport of livestock and poultry for continued breeding, aquatic fry and livestock and poultry for slaughtering arrives at the destination, the carrier shall, within 24 hours, report to the county-level animal health supervision at the place of departure Institutional report; the destination breeding farm (household) or slaughtering plant (farm) shall report to the local county-level animal health supervision institution within 24 hours after receiving livestock and poultry.
Chapter IX Legal Responsibilities
Article 47 In violation of the provisions of these measures, if the animal quarantine declaration provides false materials, the animal health supervision agency will not accept it, and the competent agricultural and rural departments will follow the administrative licensing law. Penalties are stipulated, and the owner shall not declare for quarantine again within one year.
If the animal quarantine certificate is obtained by deceit, bribery or other illegitimate means, the owner shall not apply for quarantine again within three years.
Article 48 If the carrier commits any of the following acts in violation of these Measures, the competent agricultural and rural department of the local people's government at or above the county level shall impose a fine of not less than 1,000 yuan but not more than 3,000 yuan; if the circumstances are serious, a fine of three A fine of not less than 1,000 yuan but not more than 30,000 yuan:
(1) Failing to report to the animal health supervision agency at the place of departure after transporting livestock and poultry for continued breeding, aquatic fry and slaughtering livestock and poultry after arriving at the destination; (2) The animals are not transported according to the destination stated in the quarantine certificate;
(3) The actual number of animals transported is less than the number stated in the animal quarantine certificate and there is no legitimate reason.
Article 49 In violation of the provisions of these Measures, if a breeding farm (household) or a slaughtering plant (farm) commits any of the following acts, the competent agricultural and rural department of the local people's government at or above the county level shall impose a fine of not less than 1,000 yuan and 3,000 yuan The following fines; if the circumstances are serious, a fine of not less than 3,000 yuan but not more than 30,000 yuan shall be imposed:
(1) After the livestock and poultry used for continuous breeding, aquatic fry and the livestock and poultry used for slaughtering arrive at the destination, they do not report to the place where they are located. (2) Accepting animals that should be quarantined according to law but not quarantined;
(3) Accepting animals entering the province without a designated channel;
(4) Receive animals that are not transported in accordance with the destination stated in the quarantine certificate.
Article 50 Other acts in violation of the provisions of these measures shall be punished in accordance with the relevant provisions of the Animal Epidemic Prevention Law.
Chapter 10 Supplementary Provisions
Article 51 Quarantine at the place of origin of aquatic fry shall be implemented by the animal health supervision agency at or above the county level that is engaged in aquatic animal quarantine.
Article 52 Animal disease testing reports shall be issued by animal disease prevention and control institutions, laboratories that have obtained relevant qualifications or accredited by national accreditation institutions, and laboratories that meet the conditions prescribed by the provincial agricultural and rural authorities.
Article 53 These Measures shall come into force on year month day. The Ministry of Agriculture issued on January 21, 2010, and the Administrative Measures for Animal Quarantine revised on April 25, 2019 was repealed at the same time.
