The judge interprets the law and reaches a settlement
Although my dog is not on a leash, but it did not bite you, why should I pay? The court filed a lawsuit, asking Xiaoli to compensate her for medical expenses, mental damages, and nursing expenses totaling more than 20,000 yuan.

During the trial, both parties had their own arguments, and the presiding judge, Zang Tongliang, explained the law for both parties: According to relevant regulations, dog-raising units and individuals should keep their dogs on a leash or in captivity; Civil Law Article 1246 of the Code stipulates: If the management regulations are violated and the animals fail to take safety measures to cause damage to others, the animal breeder or manager shall bear the tort liability and can prove that the damage was intentionally caused by the infringed party. Liability can be mitigated.
The judge said that in daily life, sometimes in public places, dogs that are not on a leash, not led by the breeder or manager, suddenly run out and bite pedestrians, causing casualties. Condition.
In this case, the defendant, Xiaoli, did not take any safety measures against the dog. Although she was not bitten, the plaintiff, Auntie Li, was frightened. In response to such situations, animal breeders or managers should and must bear corresponding responsibilities.
“Although the plaintiff spent a lot of money in this hospitalization, he does have some geriatric diseases. I hope you can all take a step back.” Judge Zang explained the law from the perspective of legal and rational reasons.
After patient persuasion, the two parties finally reached a mediation agreement, and the defendant Xiaoli compensated the plaintiff for economic losses of 4,000 yuan.
